Tenant's Rights
The City of Snohomish's municipal code does not currently include tenant protections. However, Washington State provides the following tenant protections per RCW 59.18:
Tenant protections in Washington State
Before Moving In:
- Rental Agreements: Landlords can set rules in rental agreements, but they must comply with state laws.
- Deposits and Fees: Security deposits can be paid in installments, and landlords must return them within 21 days after moving out, minus any lawful deductions.
While Living There:
- Landlord Responsibilities: Landlords must maintain the property and make necessary repairs.
- Tenant Responsibilities: Tenants must keep the property clean and not cause damage.
- Entry: Landlords must give at least 2 days' notice before entering the property, except in emergencies.
Moving Out:
- Notice: Tenants must provide proper notice before moving out, typically 20 days before the end of the rental period.
- Deposit Return: Landlords must return the security deposit within 21 days, with an itemized list of any deductions.
Evictions:
- Just Cause: Landlords need a valid reason to evict tenants, such as non-payment of rent or lease violations.
- Legal Process: Tenants have the right to a court hearing and may qualify for free legal representation if they have low income.
Abandonment:
- Definition: A rental is considered abandoned if the tenant is absent for a significant period without notifying the landlord and is behind on rent.

Tenant protections in Snohomish County
Notice and Offer to Sell to Tenant:
- Developers must offer to sell the rental unit to the tenant before selling it as a condominium.
- The offer is exclusive to the tenant for 45 days, with an option to extend for another 45 days.
Tenant’s Right to Rescind:
- Tenants can rescind an agreement to purchase within 10 days of acceptance.
- Developers must refund any deposits or earnest money immediately upon rescission.
Limitations on Evictions:
- Developers cannot evict tenants for 90 days following the notice of conversion to a condominium.
- This does not prevent tenants from evicting subtenants as per the law.
Tenant’s Right to Vacate:
- Tenants can terminate their tenancy after receiving the conversion notice.
No Rent Raises During Notice Periods:
- Rent cannot be raised during the 90-day notice period following the conversion notice.
Termination of Tenant’s Rights:
- Tenant rights cease upon voluntary relinquishment, purchase of the unit, eviction for good cause, or sale of all units.

- All required notices must be personally served or sent by registered or certified mail.
